Terms of Service

By using electric motorbike rental services at XanhMoto, you agree to all the terms, policies, and privacy regulations set forth below. Please read them carefully before making a reservation.

1. Rental Requirements

To ensure legal compliance and safety for both parties, renters must meet the following requirements:

• Age: Must be at least 16 years old with full legal capacity.
• Driver's License: Electric scooters with power equivalent to over 50cc require a valid Driver's License (or International Driving Permit - IDP for foreign tourists). Electric scooters under 50cc equivalent do not require a license.
• Identity Verification: Present a physical ID card or Passport for staff verification photos. XanhMoto does NOT keep original documents.

2. Deposit Policy

For special cases (large group orders, long-term rentals), customized terms will be arranged and communicated in advance.

3. Rental Duration & Hourly Late Surcharge Policy

1 rental day equals 24 hours, calculated from the exact pickup timestamp to the same time next day. For example, picking up at 09:00 on March 21 and returning before 09:00 on March 22 equals 1 rental day.

If returning late beyond the agreed return time, surcharge rules are applied transparently as follows:

Rental Extension

To extend your rental, please notify XanhMoto at least 1 hour prior to your original return time. Extension fees are calculated based on the rate tier matching your total cumulative rental duration.

4. Pickup & Self-Pickup Policies

Self-Pickup at Store

When picking up at our store, you can test-drive vehicles and receive operational guidance from our team.

Hotel / Location Delivery

Doorstep delivery and pickup services (hotels, airport, railway station) follow these rules:

• Rentals 2 days or longer: 100% Free Delivery & Pickup (Freeship).
• 1-day rentals: Delivery & return surcharge of 50,000 VND/bike.

Note: Free delivery applies within a 5km radius from XanhMoto headquarters. Further locations may incur an agreed distance surcharge.

Delivery operating hours: 07:00 – 21:00 daily.

5. Extended Service Plan (Insurance)

XanhMoto offers optional Extended Service Plans ranging from 30,000 VND to 60,000 VND/day. Purchasing a plan waives repair and damage expenses resulting from collisions or minor accidents during usage according to plan coverage.

6. EV Energy & Battery Charging

Vehicles are handed over with at least 80% battery capacity. You can flexibly recharge energy using 02 convenient options:

• Option 1 — Quick Swap at Station: Free and instant 1-minute battery swaps at hundreds of automated VinFast V-GREEN swap stations nationwide.
• Option 2 — Hotel/Home Charging: Vehicles include a genuine portable charger. You can conveniently charge overnight at your hotel or homestay (0–100% in 4–6 hours) for a seamless next-day schedule.
• Battery Preservation: Renters must not leave the battery drained below 5% or deeply depleted for extended periods. If violation causes battery damage resulting in warranty claim denial, renter bears full actual repair or replacement costs.
• Renters must never replace batteries with non-genuine parts or tamper with physical battery cells or motor controllers.

7. XanhMoto's Responsibilities

• Hand over technically safe, regularly maintained vehicles.
• Provide 02 standardized helmets and essential accessories (vehicle locks, charger).
• Provide a copy of vehicle registration and mandatory civil liability insurance.
• Provide 24/7 emergency technical support. In case of manufacturer faults, XanhMoto provides a replacement vehicle free of charge.

8. Renter's Responsibilities

• Legal Compliance: Strictly obey Vietnamese traffic laws, wear helmets, and NEVER drive under the influence of alcohol or drugs.
• Vehicle Care: Keep the vehicle safe and locked when parked. Notify XanhMoto immediately upon discovering any issues.
• Traffic Violation Fines: Renters bear 100% responsibility for traffic fines and photo enforcement tickets (phạt nguội). Renters agree to pay any fines incurred during the rental period. In cases of intentional evasion, XanhMoto reserves the right to transfer contract data and ID copies to traffic authorities.
• Prohibited Uses: Pawning, sub-leasing, illegal street racing, or modifying parts.

9. Damage & Compensation

If vehicle damage occurs due to renter fault:

• Severe damage: Compensation based on genuine replacement parts. Non-genuine parts or welded body repairs are not accepted.
• Minor scratches not requiring part replacement: Fair market repair rate.
• Total loss or vehicle theft: Compensation matching the appraised vehicle value at rental time.

10. Cancellation & Refund

XanhMoto operates on transparency: “Pay for what you use — Zero penalty for cancellations.”

• Booking Cancellation: Cancel anytime before pickup with zero cancellation fees.
• Service Mismatch: 100% full refund if vehicle does not meet advertised standards and no suitable replacement is available.

11. Vehicle Recovery & Dispute Resolution

• If a vehicle is over 24 hours overdue without communication, XanhMoto reserves the right to use GPS tracking to unilaterally recover the vehicle and report to authorities.
• Disputes will be resolved via negotiation first, or at the competent court in Da Nang if unresolvable.
